What a ДЗК extract is

The State Land Cadastre is the single state record of land parcels in Ukraine, and an extract is an official statement of what that record holds about one parcel on the day it is issued. It identifies the parcel — its cadastral number, its boundaries, its area, how it may lawfully be used — and it is issued by a state cadastral registrar under the Law of Ukraine "On the State Land Cadastre" (No. 3613-VI) and Cabinet of Ministers Resolution No. 1051 of 17 October 2012. What it is not is a title document: it describes the land, not your right to it. Ownership is registered separately.

What the extract contains

The extract reproduces the parcel's entry in the Поземельна книга. Its exact composition depends on what has been entered for that parcel, but it normally covers:

  • the cadastral number and the parcel's location
  • the area, and the measurement it was derived from
  • the land category and the designated-use code (КВЦПЗ)
  • the boundaries, and the coordinates of the turning points
  • restrictions on use and registered encumbrances
  • the normative monetary valuation, where one has been approved
  • the form of ownership

With or without property rights

The extract comes in two variants, and picking the wrong one is the most common mistake. One includes property-rights information drawn from the State Register of Real Property Rights through data exchange between the two registers; the other omits rights that arose after 1 January 2013. A notary handling a sale will normally require the variant that carries the rights information, so check which one the recipient expects before ordering.

When you need one

The extract is required wherever a parcel must be identified precisely rather than described loosely:

  • sale, gift or exchange of a parcel — the notary will ask for it
  • inheritance, when the estate includes land
  • a mortgage or any pledge of land as security
  • entering into or renewing a lease
  • changing the designated use of a parcel
  • boundary disputes with neighbours, and court proceedings generally
  • checking a parcel before you buy it

Who issues it, and who may ask

The extract is issued by a state cadastral registrar, by an administrator at a центр надання адміністративних послуг (ЦНАП), or by an authorised officer of a local self-government executive body. Держгеокадастр is the body responsible for the service. Cadastre information is open: an individual, a sole trader or a legal entity may request an extract for any parcel, and you do not have to own the land to ask. State bodies and local authorities request it on a stated legal basis.

How to order one

Whichever channel you use, the request is built around the cadastral number, so find that first:

  • establish the cadastral number of the parcel
  • submit the application — in person or by post at a ЦНАП, or electronically through the state e-services and the public cadastral map
  • give your identifying details and, for an electronic request, an email address
  • pay the administrative fee
  • receive the completed extract

Cost and how long it takes

The administrative fee is set as a fraction of the subsistence minimum for able-bodied persons as it stands on 1 January of the year in which the service is provided — for an extract about a land parcel, 0.05 of that amount. Because the base changes every January, quoting a fixed sum here would be wrong within months; expect a figure in the region of one and a half hundred hryvnias and confirm the current one at the point of ordering. No additional charges are permitted. The timing is the good news: an extract about a land parcel is issued on the day the application is received, unlike other kinds of cadastre extract, which take up to ten working days.

ДЗК extract vs ДРРП extract

These two are constantly confused, and the distinction is simple once stated: the cadastre describes the land, the rights register describes who holds rights over it. A ДЗК extract tells you that a parcel of a given size, use and shape exists at a given cadastral number. A ДРРП extract tells you who owns it, on what basis, and whether it is mortgaged or under arrest. A serious pre-purchase check needs both, because a parcel can be flawless in the cadastre and encumbered in the rights register.

Much of what an extract states is already public. What the map cannot give you is an official document with legal force, and that is the whole reason the extract exists.
